If I co-own a house with someone that does not want to sell, can I force a sale anyways?

I purchased a house with someone and I do not even live in the house. How can I get off the loan? Can I put the house up for sale even if the other person does not want to sell?

  1. Im not a lawyer but you've got to be able to sell your half. I used to live with a Jersey girl [Channel isles] land her folks had bought the house for 100 years. There's All kinds of stuff can be done with property. But that half is yours and you've got to be able to sell it.
  2. You cannot get off the loan without a refi. You cannot sell the house by yourself. Even if the title is held in tenants in common. The other party has to agree. Only way around this is to get a court order. Not what you wanted to hear I know. Only option is to work it out.
  3. Refi is required. You might be able to force a sale through an order of partition.
  4. You may get off the mortgage #1 by a sale of the property #2 the other person assume the mortgage loan through the current lender #3 the house is refinanced through the current lender or a different lender #4 get a court order forcing the sale. There are provisions for you to sell your portion based on how you currently hold title to the property. For tax and legal matters you should consult your tax consultant or attorney.   5. You cannot force a sale. You cannot "get off the loan" except by: 1. Paying off the loan. 2. The other party refinancing in their name alone.
  6. You can only sell their property against their will if you have a court order to that effect.
