Is my contract with my realtor valid?

I am a prospective home buyer and I have signed a contract with my realtor stating that they will represent me, which is apart of the 40 pages of contract that includes the final price of the house for which the seller has not yet signed (awaiting my emd check) - My realtor isn't representing my interests to include contingencies withinin the contract and I just want to start over with someone who will put in writing the fixes that are needed. - Is this realtor contract not valid since it hasn't been sent over yet? Thank you, helpful responses, but I'm not level 2 so I can't rate

  1. If you have signed the contract, it's a valid contract. However, if it has not been sent to the seller yet, you can withdraw it at any time. Even if it has been sent to the seller, you can withdraw at any time up until the time the seller signs off on it.
  2. A 40 page contract? If your Realtor isn't including your contingencies that you require, withdraw the offer. An offer may be withdrawn at any time prior to acceptance. Then sit down with your Realtor and his/her broker and point out they have violated Article 1 of the Code of Ethics and Standards of Practice of the National Association of Realtors which says in part ".....Realtors pledge themselve to protect....the interest of their client." realtor.sailor
  3. You say you have a contract signed with a Realtor, is this purchase contract for the home or a contract stating you have a working relationship with that particular Realtor? There is a HUGE difference here. Every contract can be contested. That does mean it can be dissolved HOWEVER ALL Transaction of real property require signatures from every one involved, google "Statue of Frauds". What ever agreement you have with your Realtor maybe valid but you have no contract as far as purchasing the home until the seller signs. Discuss your issues with your Realtor and their broker. If you can't resolve it file a complaint with the state board. You probably won't be able to just "start over" with the same home. If that Realtor showed you the home that you are buying or think of buying they will be considered the "Cause of the Sale" and will be entitled to the commission. No other Realtor will want to work with you unless some sort of other arrangement can be made.
  4. It's not clear from your posting whether you signed some kind of "exclusive buyer's agent" contract with the realtor or whether the "contract" you're talking about is a purchase offer on a specific property. Which is it?
  5. Yes, the contract is valid, but you have alternatives. You need to contact the supervision broker over this Realtor and ask to be re-assigned to another agent...your contract is legally with the broker, not the individual agent. Have you even spoken up? It doesn't sound like you have. You need to make things CLEAR of what you want and how you want to proceed with the offer.
