Land question in Mass? We live in Mass. Our lot is very odd shaped, we are discussing with our new neighbor (new land owner lot has not been built on yet) doing some type of land contract/ variance or legal agreement to adjust the lots so they are a little more functional. We both want the agreement to be included as a condition of sale, so that any future owner would have to uphold the land agreement, unless renegotiated by both parties. We are trying to avoid having to go through the town and actually having the lot lines officially re-drawn. Do to the rules/codes in our town we don't think they would agree to this not to mention the time and cost involved. We are under the impression that we could do this with out town approval as it is a contract between individual land owners. Has anyone seen this type of thing done before? Would you recommend having the areas of the lots that are being adjusted surveyed again? , in a Would a new survey hold up legally down the road? Would we need to survey a new survey for both lots? Or could it be done by just looking at the effected areas? If we go to the cost to do this we want to make sure that it is all legal and protected properly.
