What are the legal rights I have for not able to sale joint property by my cousin brother?

Hi, Myself is Jay and I am staying at bangalore doing JOB in IT industry. I have some property issue in my native village at uttarpradesh (Allahabad). My father is 3 brother and My grandfather has agricultural land at allahabad. My grandfather is died 6 yrs before but property is not divided among my father and his brother. My father try to divide property with mutual consultant with my tauji and local panchayat but my tauji refused the division and didnot agree on common division clause. Now my tauji son is already sale the joint property to some third party without informing any of other owner. By investigating further it is found that he has sold only his part of property and without informning us. My question is is it possible to sale joint property with division in real paper? What can I do to make the division on paper? The property consist land as well as anchetral house. What are the process to divide the property on paper by law.Pls provide these helpfull information. My father is sufferung fron slip disk and can not move much and I am far awar from my home town and didn't get much time to fight with court case ..pls suggest some easy alternative...Thanks

  1. When a Hindu male dies intestate his property devolves around his legal heirs. Section 10 of the Hindu Succession Act, 1956 gives in detail the list of Class I heirs who are to be given first preference while dividing the property of the deceased. Rule 1 of this Section provides for a share of property for the widow of the deceased. Rule 2 of this Section provides for a share each for the surviving sons and daughters and the mother of the deceased. Your father has to apply to the Allahabad court for a Succession Certificate. If you want your legal rights then you have to fight for them. There is no easy way out. HMT
