Buyers Agent and Homes For Sale by Owner?

I am looking at buying a house and have a relator but we found one house that is for sale by owner. Can my relator help us purchase this house? Does the seller still pay the commision? Thanks for any help.

  1. your agent needs to approach the seller. The agent would seek two things; the agreement to pay a commission of 3.5 [or whatever #/$] and to present your purchase offer. IT is imperative that the agent does not seek a listing. IF he gets a listing, he must represent that seller. YOU never ever want your agent to do DUAL AGENCY REPRESENTATION [by law, a dual agent may NOT negotiate for the buyer, only submit offers.]
  2. You have a real estate agent that you signed an agreement with. The agreement is somewhat that the real estate agent is seeking a commission for introducing you to sellers of houses. This agreement also say something to the effect that if a property is found within a certain period of time that this real estate agent would want to be enumerated. I am sure your agreement does not say that if you find a house being sold by the owner that you would not have to pay the commission expected by this real estate agent that you signed a contract with. Here is what is gonna happen. Your real estate agent will write up a contract to present to the owner that is selling their home. Also the real estate agent will tell the seller that since you are selling their house and I have a buyer it is expected that you the seller pay my commission which is approximately 3% of the sales price. The owner of seller will then ask who signed this contract with you about me paying you 3% of my sale price. The reason I am selling my own property is I don't want to pay a real estate commission. Since I did not sign an agreement with you I am not prepared nor will I pay you a commission. Now who do you think the real estate agent will look to for the payment of their commission? The real estate agent would normally look to the person that signed the agents agreement. Now there will be some that will say the owner should reduce the sale price by what they would have paid a real estate commission. This is hog wash. The reason owners sell their own property is to realize as much profit or equity out of their property as they possibly can. The bottom line is that if the sellers or owners of the property fail or refuse to pay the real estate commission then you are the one stuck with this commission because you signed the agreement with the real estate agent.
