House for Sale without owner's consent... legal?

Hi there. I have a mobile home that is under my name and my ex-boyfriend's name. We had been together for four years, purchased a mobile home in 2007. We broke up in early 2009. Both of our names are on the title for the home. He moved out of the trailer after we broke up, and I remained. In late July, I moved to a different city so I could go to college and start anew. Once I left, he moved back in. Just last week, I saw the home is for sale on mls listed under Re-Max. I phoned the realtor, and asked what was going on. She told me she would get back to me, which she hasn't. I thought that you needed signatures accompanied by ID in order to sell, or even list for that matter, a home. I have all the paperwork filed away here to prove I am on the title. What should I do? Is this legal? What happens if it sells?

  1. i would contact the realtor to see if your ex is filing a lost title. if he is, and you have the paperwork, you should contact the realtor and explain you are 1/2 the owner.

  3. No, it is not. Get a lawyer, in the meantime show the realtor copies of all of your paperwork.
  4. Don't talk to a real estate agent, talk to the Broker! He's on the hook for any mistakes made!! If you want to get rid of the mobile home, tell the Broker you want YOUR name on the papers too as you are co-owner, Otherwise, go get a real estate Attorney. Who has been paying for the space? and who has paid the most? Did you BOTH pay equal amounts for the down payment? You both will have to pay taxes and closing fees to the Agent. Call today, if not - do it tomorrow.
