Pls tell me if there is two sale deed of same property what happens and How to file a case against land Owner?

We have bought 4 acres(Half land) of agricultural land from 8 acres in Gujarat from Person B.7/12 document has name of Person A Second Party B has purchased that land from them and have registered sale deed but due to unpaidloan by A 7/12 Name transfer was not done as per Mamlatdar Office.Now after getting all loans paid we bought land from B and Made sale deed and got it registered.Now when we have gone for 7/12 name Entry we can to know that there are 2 sale deed agreement of same land and due to that entry in 7/12 is not possible because we bith have claimed for Entry.Pls suggest wat to do in such case?Should we file complaint against land owner? What would be the procedure? What laws r there 4 such frauds? wat should we do to get land cleared?

  2. Generally when a sale deed is executed and registered by a land owner, he ceases to have any right over the sold land. If he has executed one more sale deed by concealing the facts, he is liable for criminal action. The officials in “Mamlatdar Office” ( I donot understand Mamlatdar but may be equivalent to Tahsildar in our region in charge of land & land revenue ) should deal with the matter by evaluating which sale deed is earlier and 7/12 entry shall be made in favour of first document holder by earlier date. If your sale deed is earlier, you are safe. If your sale deed is later, you may have to file the criminal complaint only against the party who sold you.
  3. When you purchased the land the Title Co. should have run a title check to make sure there were no liens against the property and issue you a Title Insurance Policy. If you have that then you need to go back to the Title Co. j
