Who can be legally sued?

Here is the issue: I bought my house and put a down payment on it with a man who worked for the trailer court. Come to find out, the man who took my money as a down payment, took the money and never gave it to the owner of the park toward my house. He just took the deposit amount off the sale price and pocketed our deposit. Since he worked for the owner, and no longer works for the owner, who would be held responsible? The employee or the business owner? I was told to sue the owner of the park, and THEY would have to go after the employee.....does anyone have any legal adivce? Thanks

  1. You should sue them both. It's a heck of a lot easier to just add a name to the complaint than it is to file another complaint if you pick the wrong one and your suit gets dismissed. However, the employer will likely be held liable. Most employers are held liable for the actions of their employees when the employee is acting within their duties. If it was the employees duty to collect money on behalf of the trailer park, then the trailer park is liable for the employees wrongful actions through vicarious liability.
