Used car sold by private owner...?
When I sold the car to this crazy lady, I wrote a receipt saying she paid X amount of money for the car, but I didn't mention the words "AS IS"...Now she decided she wants to return the car just because she doesn't like it, even having the car checked by a proffessional chosen by her before she bought it... My question is: Are all private sales of used cars considered AS IS? And can she really return the car to me? She wants money back. She bought the car 36 hours ago. I am in Texas.

- You don't have to take it back.
- Typically, once the buyer takes delivery (or posession) of the vehicle, it is theirs. Expecially if the title work has already been done and transfered to the buyer. It's usually a good practice to have AS IS on the title, but I think as long as there was no agreement for any type of warranty, then she's pretty much stuck with the car. She may try to threaten you, but I'd just tell her that it's HER car now and if she doesn't want it, she'll need to sell it on her own. even any judge will say "buyer beware" good luck p.s. helpful tip...don't sell something to a crazy person LOL
- You'd have to check your local laws. MOST states don't even have lemon laws for private sellers. SOME states, however, have 3 day (72 hour) return clauses on all purchased goods (although to my memory it excluded large items such as homes, cars, etc).
- Check your State's transportation laws, sales of used autos. Every State may be different or the same for most.
- Depending on what state you live in, the laws vary. But there is a time limit on when she can bring it back. Usually it's around three days. But all you have to do is refuse. She can't bring the cops over and make you refund her money. But she can take you court. That is a lot of trouble for her to file the suit. And if she loses in court, she has to pay the court costs. You would win a court hearing if what you told me is true, because this sounds like a case of her just changing her mind. That is not your fault. She has no leg to stand on, so don't give in, unless she's a friend or coworker who is liable to make you life hell. Good luck, and stick to your guns!!! TT
- It doesn't matter if you wrote "as is" on the bill of sale or not. Unless the seller provides some type of warranty, ALL private party used car sales are considered "as is". She can try to to return the car, but you DO NOT have to return her money or accept the car back. It doesn't matter if she bought the car 36 minutes ago, the sale is final. Tell her to go pound sand and to leave you alone or you'll have her charged with harassment.
