How can I get the land which is occupying by me for 50 yrs? I've got Agreement to Sale from the owner too.

The land belongs to me and my brother equally. My brother never stays there. He has settled in another state for 50 yrs. In the year 2001 my brother wants to sell his share of land to me. I agreed and we made an unregistered Agreement to Sale. According to the agreement, I have paid 18% of the price and the remaining has to be paid in next year. If I fail to pay he has to refund my money. But I fail to pay the amount on time. Now he wants to settle at his share of land under the influence of our eldest brother, who wants to get some of his properties. Now , he is not agreeing with my request to transfer the ownership of land by paying the dues of 82%. How can we settle this problem? How can I get Ownership of the whole land.

  1. Try registering the exisiting agreement. Was it notorized? Probably check with an real estate attorney and see if the agreement you have is legal. If so you may have to pursue legal action. If not check the current title , if it is a joint tenancy or a tenancy in common. In a joint tenancy itle There is only one title to the whole property. (Joint ownership in undivided equal shares.) So he can't sell to anyone else except you , if you brother dies you will get the whole property. tennancy in common means the other persons share goes to who they specify. good luck
