Online House Hunting

Do I have a law suit if the person we bought our house from didn't disclose a sink hole nest door?. Florida.

We live in Spring Hill, Florida. We bought the house a little over a year ago and now we have a sink hole. The house next door to us has had a sink hole.

  1. Probably not. Seller disclosures generally only require information relative to the property which you purchased, and not regarding the property next door. You would have to prove in a court of law that your seller knew that there would be a sinkhole on your property in the future, or that the chances of such were high and well known. Your chances of prevailing with such proof in court are not good.
  2. i dont think so it'll be tough proving that they knew about it , plus you had an inspection when you bought it .... so i dont know good luck
  3. if the seller knew... lots of cases..but you have to prove the seller knew. now....... most lawyers....if they think they have a case will take a case for free under the condition they get a % if and when they win not sure how much Florida lawyers charge..here ..it is in the "yellow pages" of the phone book and most say..they will not charge for a consultation..and the "contingency fee" if they take..the case.. if no one is interested........ then that is that........... don't wear your shoes out running around the issue..they won't touch it cause there is no money in it.. i knew a lawyer took a "case" knew he wouldn't make a cent..but he did it for the "publicity".. so there is that as well....... good luck..
  4. If your sink hole did not exist when you bought the place there was nothing for them to disclose. Nothing about the neighbors property would be included in your disclosure.
  5. Most likely not. It is not up to the seller to disclose what is on other people's property. If you could prove they knew this was going to happen to this home then maybe. The question is how do you prove they knew it would happen just because their neighbor has a sink hole? That is like saying my basement may get water because my neighbor's does. That is ludicrous, My neighbor gets water every time we get a drop of rain, I have never gotten any. So why would I have to disclose that? I wouldn't, same reason the people you bought your home from wouldn't have to disclose the sink hole.
