investment property? I really want to buy a rental investment (like duplex) and I need some guidance: 1. Should I form an LLC to protect my potential lawsuit and purchase that rental property under that LLC? can I avoid an LLC due to fees/costs? 2. Investment Property? If i purchase triplex as an investment property in California but later on decide that i want to live in it, can i? Rules about it and things i need to know if i decide to do this. If I rent then live in it and rent again any rules? When the units are being rented I need to claim rent as income on my taxes and then i can subtract expenses( HOA, depreciation, etc..) . So when I move in can I claim 1/3 of the property as my primary residence and have my interest on mortgage tax deductible?

We are buying an investment property. With little to put down, what is the best way to finance the property? We have a large amount of equity in our current house. We have no bills other than the mortgage on our current house. Is a home equity loan to get to the 20% down payment and then a conventional loan on the investment property itself the best way to go? When realtor buy an investment property and put their realtor rebate back to the settlement, is it taxable? I have two answer. 1) If put back to settlement, it is not taxable. It only reduce your purchase price, when you sell your investment property, you have to pay tax. You only need to pay tax if you get check directly from the builder. 2) Another group think 1) only apply to second home. How do I report interest in 2006 for an investment property sold in 2005? Hi. I received a 1098 substitute form in the amount of $2000 for interest on an investment property loan. Funny thing is, I sold that property on Dec 30, 2005. So for my 2005 tax return, I submitted a form 4797 for the sale of the property. So maybe the loan wasn't paid off right away and interest accumulated in 2006. The 2006 interest must have been paid from the closing costs… after the closing on Dec 30, I did not personally pay for any additional expenses on the property. So how do I report what would normally be a business expense of $2000 for a property that I never owned in 2006? Or maybe I should not include the 1098 in my 2006 return since I did not pay anything on that loan in 2006??? Thanks for any good advice.

Roofing Contractor suggested doing just half the roof for an investment property. does it make sense? Hi, A foofing Contractor I contacted suggested a new roof for just half the roof of an investment property. I own an investment property that is now inhabitable. What are my options to stop losing money? Due to the neigboring unit's overflooding, my unit flooded causing major mildew damage. The property is inhabitable and the area has rundown. I do not want to pay mortgage every month for a property I can not sell and can not rent. Can you have LLC set up as a property manager for investment property? I'm curious if you own a rental investment property under your individual name, can you have your LLC set up as the property manager and hence provide the protections of the LLC. Bascially, the renters would sign a lease to the LLC, and the LLC would "pay" you the individual. Trying to leverage the protection of an LLC but since it's difficult to purchase under an LLC, you would have the house under your own name.

How to sell an investment property fast? A freind of mine has an investment property in Atlanta Georgia that he is trying to sell. It is a 4 year old Duplex with 4 bedrooms and 2 baths in each unit. It needs no repairs, it was built in 2002, it has wood floors throughout and it is close to public transportation, colleges and downtown. Should I buy my own condo or an investment property? I'm just out of college and in the finance world. I have been just told that Im...? discriminating because I will not rent my investment property to people who do not have reliable employment. I have been told by few people that I am discriminating against them, but how do they expect to pay $280/week in rent if they dont work? Im looking at buying an investment property and need some advice? I'm looking at buying a particular property as an investment. It has a decent gross rental return (6%) but has been on the market for 6 months and has not risen in value over the last 5 yrs (as stated by the real estate agent). It is close to the town centre of a growing town, and has a very steep driveway. It is 10 years old. I intend to get a soil inspection to ensure the ground is ok, as the house is on a high. Should I make an offer, say 5% less than the asking price? Why wouldnt the property increase in value when all other properties in the area have? The asking price is 235,000, rental income is 270 a week. The current tenants have been in there for 5 years and are happy to stay longer. It is through a commercial realtor. I probably wont use a property manager as it is low maintenance and there are existing tenants. It is a quiet street, which isn’t far walk from town centre. I will get a building inspection
Can rental losses be subtracted from capital gains when selling a rental investment property? My wife and I live in a rented apartment in CA and own a home in AZ that we have rented out. Last year our losses on the AZ property (Interest + prop. taxes + repairs + depreciation - rentalincome) was 14K (reported in schedule E and form 6198). Now since our total W2 wages in CA are >150K we can't deduct the 14K from our adjusted gross income. Question is can this no. be carried forward each year (as losses) and later when we sell the rental investment property can the sum of all these yearly losses be subtracted from the profit we make by selling the rental property? Also, someone suggested that the smarter thing to do would be to form an LLC and start getting a tax-break from the losses we are making every year. Is that true?
