I have a copy of HUD estimate approved by the seller’s lender. So I know all lien holders. I also can do the last minute search on the Internet right before the closing in order to avoid any surprises. In this situation, do I need a real estate attorney to make sure all liens are satisfied and I get the property with the marketable title? Or closing title company can handle all this issues? My real estate agent advises to hire an attorney for the flat fee of $1,000. Will it be a waste of money in Florida? Thank you! My house is the short sale status, what next? Ok, it is actually for a loved one. I have decided to pay off his vehicle for him. What happens if the house is not sold in whatever the time period the bank has set (is it typically 6 months?) After that does it go to auction? My main concern is that if it goes to auction that the bank would try to seize his assets. I would not want him to lose his vehicle that is paid for. It's a Dodge truck 2004 i think. Please help me find out how to fight a contractor lien against my house, the contractor was hired by the buyer I owned a house in Florida and I was under contract with a buyer for the sale of the house, before the closing the buyer hired or made some arrangements for a contractor to do work on my house when I wasnt there without my permission, the buyer then chose not to buy the house and the contractor stuck me with the bill, I have an affidavit that my realtor never gave the contractor permsion nor did I ever give the contractor permission. I believe the buyers agent contracted to have the work done for her buyer. the contractor claims he made improvements to the house, but on my contract with the buyer I wrote AS IS, I did not want to make improvements to the house so why would I ever authorize any improvements. I was giving a credit to the buyer for improvements that she wanted done to the house, she in turn decided to hire a contractor I believe and thought when she got her credit from me during closing she would pay the contractor off. Short sale or live in the house? I have an interesting situation. In 2005, I bought a house in Florida for $450,000. Ever since I was able to rent it and had to put in about $800 a month to cover the mortgage/taxes/etc... Not so bad. Recently, my tenant has left and now the house is vacant. I have decided to move into the house with my family. My situation is as follows: The house is now appraised (yes I got it appraised officially at $220,000). That is very unfortunate. Originally I have put down $100,000. My mortgage balance is $330,000. Therefore, I am upside down in that the house is worth less then the mortgage. Question: Should I short sell the house and loose my $100,000? And then buy another house in the area? Or should I just live in the house and then stick it out for several years hoping it will go back up. I appreciate your help and answer in the matter.

Can I get out of a lease if my landlords put our house up for sale? We have lived in our house for approx. 4 1/2 months and our real estate company just put a for sale sign in the yard out of nowhere. Now they have a lock box on our house and that means strangers in and out showing the house. Can my landlord sue me for backrent without a lease and he is forecloseing on his house or quick sale? We have lived in my home for over 7yrs, we are getting letters on the door from he mortgage company and it's to the collections department. He also said he is putting our money that we give him in an escrow account which I don't believe at all. We do NOT have a signed lease just a verbal agreement. We did find another home and we are moving to get away from the mess. My boyfriend is wanting to pay double rent for a couple of months to help him out, fix the place up so he can sell, now remember the landlord lives in Florida and we live in Indiana. I think it's really crazy to pay him rent when we won't live here. Can he sue us for back, I couldn't even tell you how much it is. Want to sell duplex in florida, but tenant is giving me a hard time. What can I do? I have a duplex that I would like to put up for sale in Florida, but my tenant on one side of the duplex is giving me a hard time. She signed a lease in February of 2007 and was told prior to signing that we would be selling the house within the next year, which she was fine with. Last week we told her we wanted to put the house on the market, and she flipped out on us. Her friend is a realtor (an obnoxious loud mouthed one), and told her that she can break her lease and move out as soon as I put the house on the market. The lease really doesn't have any specific clauses in relation to a home sale nor can I find it in the state senate statutes. So my question is...is the tenant allowed to break her lease and move out? I do not want her to move out as it is easier to sell a tenant occupied house. I've already told her that we want her to stay and that we would see to it that a new owner would have to honor her lease. Any info or websites would be appreciated....thanks!
A question for realtors in Florida? My husband and I are purchasing a home. Closing is in a few weeks. The house was a short sale and our Realtor says it is an "arms length" contract and this means that we can not have any direct communication with the seller at all. Our issue is that the house has an island kitchen. The island has a butcher block top and the cabinets underneath match the rest of the kitchen. When we made the offer we did so under the impression that this island was a part of the house. A week after our offer was submitted we had an inspection. At that time, I leaned against the island and it moved! So by accident we discovered that this cook island is not bolted to the floor. Our realtor has told us that since it is not a "permanent fixture" that the seller is under no obligation to leave it. We obtained the original plans for the house and it clearly shows that the kitchen has an island. In addition, when the house was listed on the MLS one of the "interior features" listed was the cook island. Now our Realtor is making us feel that we are unreasonable to expect that the seller leave the island with the house. The seller has mentioned that she is willing to sell us the island, but never specified a price. What is your take on this situation? Please only serious replies. Thank you The contract does not show that it is excluded. As I mentioned above, the island is listed as an "interior feature" an MLS---doesn't that mean anything???

Florida is currently worth approx $60,000 less than paid for in 8/2006 based on comps and recent sales and there are several in the neighborhood in foreclosure. Today a house listed for $90,000 less than what I owe. What do I do with this house? We want to move out of this state and be done with it but can't pay it off, can't sell for what we owe and we sought assistance from the mrtg comp asking for a promissory note for the difference of what the house sold for and we were told "No". What would happen if we moved for a job and then were not able to pay for two places to live. Can we be sued? What can we possibly do to get out of this house?? Mortgage = $2350 Taxes & Ins = $750, total $3100 a month. Cannot possibly rent for that amount.

Why would the house number on a house not match the legal record? I'm in the process of purchasing a short sale property in Florida. The house number on the MLS listing and on the house itself is 511 NW ... ST. However, when I went to look up the house on the county property appraiser's website, that home did not exist. The number according to the appraiser and other legal records is 507 NW ... ST. Why might this be the case? 1. The MLS address is not a typo: that is the number ON the house that I walked through with my agent. 2. Yes, I've been inside the house. 3. The bank already approved the sale, and the contract is written with the same number that is on all the legal documentation (deeds, appraisals, etc.). 4. There is no house numbered 507 on the street.

Mary is a resident of Florida and inherited 20 acres of land in california.She decided to sell the property to Franklin Contractors in the amount of (500,000.00). Franklin Contractors, Inc.,wants to provide a down payment of 100,000.00 and pay the remainder of the purchase priceover a ten year period. Howard Franklin plans to subdivide the property and construct houses on it. How would I write a legal memorandum addresing the terms,transfer, third party transfers,legal principles? Please help

Selling a single family house immaculate in gated community? My husband and I just put our house on the market. We live in a beautiful gated comm. Our house is only 9 years old and has new kithen and floors. There are 3 other homes in our community for sale priced 20 to 30 thousand dollars above our price. We live in south florida. Our realtor seems to think the market should pick up in the summer. Does anyone have any insight? Thanks
Is this a good deal for a house? My husband and I found a house on .24 acres of land. It is 1549 sq feet...three bedrooms, two bath, two car garage, eat in kitchen, front porch. It doesn't have a pantry or a separte dining room area. The house has been forclosed and is bank owned. The house looks like it is in great condition...of course we will get the best of all inspections if our offer is accepted...we are using VA loan... We did some tax research on the house and found that the house was originally bought for $219,000 in February 2007. The house was last appraised at $147,000 in 2007. The house became bank owned in November of 2007. The house is now for sale at $124,000. The house is in Florida and is by good schools and hospitals. The only bad thing is the shopping area is 30 minutes in either direction. The house is also pretty secluded. Is this a good deal? Houses similar to that house in the same area are selling for $150,000-$164,000
Divorce question for state of Florida? We both own home; want him to move; he agrees; still pays mortgage; we put house for sale and we split profit 50/50 right? He owns a business; I don't want any of that but it might be hard to get child support from him because I can't garnish his wages because he works on commissions and keeps bad records. How would that play out? Can I get spousal or just child support? I only ask because I pay everything now but the mortgage which I would not be able to do if we divorced so I need to see what monies I would have to keep a roof over my childs head short of having to move back out of state with my parents and taking him from his dad and friends which I don't want to do. I don't want the house; its too big; an apartment is fine but even rent on a decent apt. is $1,000 per mo. so I'm trying to figure how I would do that and what his obligation is to me and our child financially in the state of Florida. This is holding me back from making my decision. Any advice? I want to stick it out for 8 years; no physical abuse or infidelity (that I know of) but lots of yelling and arguing. He is SO greedy, works long hours, doesn't participate in sons functions, gambles, drinks and only cares about his friend money problems! I have never cheated the IRS; we file faithfully so your right about using the tax returns; I never thought of that. Son will be 18 in 8 yrs.
Can the buyer of a short sale home, turn around and rent it back to the people that are short selling? We are trying to short sale our house and were approached by some people from up north that wanted to buy some property here in Florida and rent it out or a copule of years. They offered to buy our short sale house if we would sign a 2 year lease and rent from them. At the end of the 2 years they would like to either move into the house, or sell it, possibly back to us at the appraised amount. Can this be done? I have only heard of this as an issue of having family buying a short sale so their family members can stay in their own house by renting it and then maybe buy it back when it could be afforded.
Where the people leaving Florida moving to.? I live in Florida ,When I first moved into this sub division every house was full kids rode there bikes ,people played tennis and swam in the pool,now its empty .I can look out the window and count the forclosure signs and for sale signs.I have been in this area my whole life .I have never seen anything like this before.What state are the moving to ,because I need to move out myself.
