How can I get the land which is occupying by me for 50 yrs? I've got Agreement to Sale from the owner too. The land belongs to me and my brother equally. My brother never stays there. He has settled in another state for 50 yrs. In the year 2001 my brother wants to sell his share of land to me. I agreed and we made an unregistered Agreement to Sale. Is there a good way of finding someone to do a land contract that is selling a house? I can't go through a bank for financing. My parents will be giving me the $ for the house but I still can't use a bank. I really like one house, but no contact has been made with the owner. sale of main residence constructed by owner occupier & GST? I have bought land that was subvided last July ( and the seller paid GST on settling the sale of land post subdivision) and contructed a house on it ( the builder obviouslycharging GST). I am not registered for GST as of right now, I have lived in the new house as my main residence for 3 months now and I am considering selling. Would I 1. I own a building and the neighboring land owner won’t allow any of my customers or employees park in my parkin I bought a business building 2 years ago and one of the tenants wanted to co-purchase the building with me, but I decided to purchase it by myself to avoid problems down the road. Well when I purchased the building the tenant started to cause problems for me. He started by saying he wanted to expand his space so I made arrangements for him to expand, and when it came time for him to expand he decided to renege on the whole deal. It upset me but I was forgiving. Then it came time for him to renew his lease and he refused to sign a new lease (but he continued to make his monthly payments) and eventually moved out. The final straw and what I need help with is about a year ago the city had a bunch of odd shaped sections of land that they were selling off in silent auctions, and a 20ft. strip of property that separates my building’s parking lot from the only entrance to the parking lot was one of the pieces of land for sale, long story short I put in a bid and unknown to me so did my now ex-tenant and he won. Now he is punishing me by not allowing any of my employees or tenants or any of our customers drive over his piece of land to park on my parking lot and if any one does he calls the police and threatens me that he will sue. It is so bad that I used to have a dumpster in my parking lot and he wouldn’t allow the garbage truck drivers pass over his lot to retrieve the trash, so I was forced to get 10 garbage cans so that I can drag them around his property line to the ally for garbage retrieval. What can I do? Because of him not allowing people cross his land to park in my parking lot no one will lease any space in my building. How can I win? He says that he will sell the piece of property to me for 3 times as much as he paid for it, and he paid 2 times too much for it to begin with.
Am I eligible for membership of a co-operative society by becoming an owner of a property in the society? I purchased a residential land from a bank auction. The land comes under a co-operative housing society. Since I purchased the land from the bank in a public auction under SARFAESI act 2002, I am the new owner of the land. The sale certificate is the prima facie evidence of my title to the property. The certificate states that the land is free of all encumbrances. Here is my question: 1. Can the housing society where the land is located deny me membership because the bank did not require/take permission from the society for the sale? The sale was through a public auction so anyone could have participated in the auction. The bank did intimate the society about the sale recently. 2. If the society claims that the previous owner violated one of the bye-laws by not constructing a house within 3 years of his purchase and therefore the ownership of the land was revoked from him. Sale of 1 property to 2 different parties.? What can I do? I bought a for sale by owner. The owner previous to him sold the land to him and another person. Now I want to refinance the property because I put a house on it and the other owner wants me to pay him. I didnt have anything to do with the other seller making money on the property twice. buying on land contract...? I got a call yesterday from someone who we called about property they had for sale (by owner) and she said they would consider a land contract. So it's a really nice 10 acre parcel and we would love to be able to build a home on it in the future (say 2 years from now). To us this seems like it would be perfect cause we're not ready to build just yet and we could take that time to save up for a mortgage and then roll what's left to pay on the land into it. We have been approved for a mortgage, but I think it would be better if we waited a couple years until we are better established credit wise. We can't find anything we really like in our price range anyways so at least we know, when were ready, we can get what we want and it's on land we love. Is this a good idea? Also, all those monthly payments, do they provide any credit benifits, say proof of rent or something like that? We are paying rent right now, but some more proof we can make another payment a month can't hurt, right?

Fha loan question regarding owner occupancy? I have owned my home and lived there for 11 years. In May of this year my father past away leaving me his home out in the country. I painted and worked on making my house buyer friendly and placed a sign in the yard for sale by owner. I thought nothing of it. My house is empty and is for sale at this time. I have no intentions of renting it or doing land contract. I know that is against FHA regulations and have no interest in do that anyway. So today I get a letter in the mail from US Bank that says my home has to be occupied by me for the life of the loan and it must be my primary residence. I remember being told I cannot sell for 10 years and it has been more than that. I am not renting it and no person lives there right now. I cannot understand these terms. So what do people do if they have to move due to a job relocation or like in my situation inherited a home? I cannot live in 2 houses and have no desire to sell the home that belonged to my father. Am I not allowed to sell my house? They sent me a property affidavit and a nasty warning saying they will enforce rules of the loan. Do I have to live there until the day of the sale? This is just absurd. My father's home has already been deeded to me and the probate process was quick due to him having a will in place. So I own 2 homes. And I was told in 1999 when I purchased the home that I could not sell for 10 years or I would owe a percentage to them as a penalty. I have passed that amount of time. This is awful. I have had enough to deal with these last couple months. Now this??
Can My property be listed for sale without my consent? I own 1/3 of a vineyard in napa valley. No home is on the land. My mother and sister own the other 2/3. I discover it listed for sale by accident one day on the internet. I am against the sale of this land and was never asked about selling it for it to be listed. I instantly e mailed the agent who had it listed telling her who I was and to take it off the listing NOW!!! She soon found out what I said was true. My question here is. When you contact a agent to sell your property isnt there some kind of a contract that has to be signed by all owners of the property to do so? I think My sister and Mother might of forged my signature. The property is in the process of being sold to a buyer now. I have been contacted by the title/escrow company, but I have refused to sign anything untill I get some answers. I know the property can not be actually sold without my signature too. It can not be sold in sections either. I want to know if a real estate agent can list it for sale without all of the owners consent!
Is it illegal for a home owner to make false/misleading statements when selling their home? Husband and I recently went to look at a "for sale by owner" home in rural South Dakota. Prices are dirt-cheap, houses are typically OLD...and we're well aware of what the typical price range/age should be. So our suspicions went up when the home owner first claimed the house was "built in 1975" (this 'fact' is plastered all over every ad she's running for the house; it's evident to even a casual observer the house is quite a bit older)....and THEN she tried telling us the house/property were recently appraised for $220,000 (!!!) but she was selling it for a mere $45,000 to make a quick sale. o_O Sooo, occasionally I pride myself on not being a gullible idiot- I went to the county assessor's office & got public records on the house. Turns out the house was built in 1906 (renovated plumbing & wiring in 1974) and the house's value was assessed 4 years ago at $8720. For the house AND LAND (only 3 acres). She paid $20,000 for the house in 2007....has made NO improvements to the property & has actually had *renters* occupying it the whole time, yet she's trying to sell for a $25,000 dollar PROFIT in an area where home/land values have increased only a fraction of a percent. Now, I know it's not illegal to overprice a house BUT is it illegal to lie about the age & value of the house??? I know people who would NOT have bothered to go to the courthouse & do the research...some folks would have believed the lady's lies & gotten ripped off. And ended up with a century-old money pit to boot. I guess I'd like to make sure this lady can't scam anybody else like she ALMOST scammed us. The size & price of this house makes it appealing to first-time buyers and younger people.....sooner or later she WILL find herself a fool who doesn't know better. Can we do anything to make sure she can't take advantage of the next person to come along???
can i ask to purchase a home on land contract? there's a home that i'm interested in that is for sale by owner and has been that way for approx 4 months. the home is currently vacant. is it rude to ask to purchase the home on a land contract rather than going through banking channels? i'm pretty sure, due to the digging i did online, that the owner passed away in october and left it to his children (scary what you can find online in a short amount of time). i just don't want to insult them. mine and my husbands credit is ruined beyond repair and have to file bankruptcy. we would like to be able to offer them a balloon payment as soon as possible, possible after 5 or 7 years. realistically, i'd like to lease with the option to buy for 5 - 7 years and then get a loan after the dust has settled for us. i don't know how to lead into this conversation. my husband owned a business that went under. that's the reason our credit is beyond repair at this point. we both now have jobs outside of the home and are making a decent wage. although not enough to dig ourselves out of the financial hole that being self-employed costs. we may be a financial risk, but we're hard working, trust-worthy people who are just trying to stay afloat in today's day and age.

who is the rightful owner of a parcel of land? Engr. Reino S. Gutierrez owns a parcel of land where he has tenants. The land was mortgage at the bank and unfortunately the was acquired by the bank. What tenants did was to pay the all dues to pullout the land so that they can get there share. One of the tenant sell the land to me. The tenants let Engr. Gutierrez do the subdivision of the land and the transfer of titles to the buyer of the subdivided land. It is more than a year now that we have given Engr. Gutierrez the money for the transfer of title but he did not to the same. He has all the original title and deed of Sale.

Is a commercial business lease bw family members prior to a power of sale on the land still legal/binding? My uncle and aunt got hammered last year on their variety store/gas station business and fell behind on their payments on the property (which they also own). The mortgage company indicated they will do a power of sale on the land at the end of March if full payment is not made. There is no way the two of them will be able to do this and it will kill me to see them basically lose everything while in their early sixties. My friend had an idea though which consisted of me signing a lease to for the business portion because the commercial lease will have to be upheld by the next owner. This way, while they will lose the land, they will able to make a living by running the business that I've 'leased' from them, the original owners. [B]I know that normally this type of agreement between family members is fine here in Ontario but with my relatives' financial situation and the fact they already knew a power of sale would be coming, would this type of lease still be binding/legal? ?? LETTER: MOTION FOR SUMMARY FINAL JUDGMENT OF FORECLOSURE, OWNER SAYS HE'S IN SHORT SALE W/LOAN MODIFICATION? I am a full time student; I have been living in FL, for almost a year. It seems my landlord is taking money for rent on his condo that is what I believe is in foreclosure. A month or so after I signed my lease I received a packaged, inside it said, “Motion For Summary Final Judgment Of Foreclosure And Taxation Of Attorney’s Fees And Costs.” The owner/landlord says, it is not a foreclosure; they are in a loan modification with short sale. It seems to me as an attorney negotiates with the bank the owner/landlord is taking my rent and not applying it to the mortgage or HOA fees. The mortgage will not be paid so the owner will keep the money, while the attorney is negotiating the short sale. If the attorney gets the sale date held off for an extra, let’s say 10 months, then that would be $13,000 for the owner/land lord at 1300 a month. 7 months into my lease, the Association put a letter on my door in regards to the landlord/ owner in delinquent in HOA fees. If this weren’t handled in 10 days, I would be ordered to pay my rent to the Association. I demanded he handle the situation, and he did over the curse of two or three days. He told my Realtor he paid in full and extra, I was told he paid a tiny amount by the Association and still owes a grave amount. It was agreed that a temporary life on my denial of amenities would happen, but I was still denied amenities for a course of about two weeks because the owner was delinquent on his HOA fees. My amenities have been restored, but I believe that my rent following that month should be reduced. The owner doesn’t want to reduce two weeks worth of denied amenities from my rent, so I am refusing to pay. I shouldn’t pay for something I cannot use. It also seems the bank does not know I am living here, the Association never received an application for me to live here, he told them I was a relative, and when they found out I was paying rent…they decided to let me stay since I was so deep into my lease. Is there a law against what he is doing? I have no idea what to do. I am going to meet with a layer tomorrow, but, is there anything illegal that he is doing? Is my lease even valid? I found out about this Motion For Summary Final Judgment Of Foreclosure” by accident, but he says it’s a short sale w/loan mod. I looked him up in the public records, it states Lis Pendens was filed in 2009, Motion for Summary in 2010. It’s 2011! He purchased in 2007, for $237,000 and his current balance is $230,673.84 not including taxation of attorney fees, this was in one of the packages I received, in addition to the public records. Can he have a lease agreement with me after he is in default and knowing he is in foreclosure; take my money and not pay mortgage or HOA fees in the state of Florida? 2. Also, is my lease null & void, since I never went through the Association application process (I thought they submitted my info, I gave them my credit report, s.s., etc). 3. Has he breached the lease since he was delinquent on the HOA fees? He refuses to reduce the rent for the month I was denied for 2 weeks on amenities. What do I do!? I have land for sale in Chilean Patagonia....? Dear Sirs, I am contacting you to share with you information regarding a property we have for sale. It is a 2025 hectare (5.004 acres) land in Cisne Medio, Austral Road, Aysén Region in the Chilean Patagonia. In the midst of a rustic environment, surrounded by mountains, it is largely covered by native untouched forest, with a 2km long interior lake and three interior valleys, bordered by the Cisnes river and crossed by the Sandoval stream. Chile offers excellent guarantees to foreign investors, something which has been recognized internationally, it's perfectly legal for a foreigner to buy a property. There are special regulations for foreign investments, but they are relatively simple. Chile is a particularly safe and peaceful country, more over in the Patagonia, where in some places you can even leave doors unlocked with no fear something will happen. Is there a service (like MLS) that Realtors will use for listings? It seems that not all Realtors or Brokers use the Multiple Listing Service for their clients. Sometimes, I have to log directly into a website to get to a property and sometimes the MLS number is there; sometimes not. Some websites I use that use the MLS database system will not pull up some properties, but if I directly key in the MLS #, then the property will show up. Is there only MLS, or are there other major Real Estate databases being used out there? I'm not talking the "for sale by owner" type. I'm looking for land lots and acreage, and some properties just do not show up unless I do some search into the tax records for ownership, and try to aquire info that way. Land for sale for very long time. Why not lower the price? 5 acre field across the street from me has been up for more than a year. Listed, and I suspect, owned, by a small-town real estate. Originally slated as a small apartment complex, townspeople fought at townhall and plans were cancelled. Surrounded by cornfields and a few houses on about 3 acre/each. I had a nosy friend call when it first went up (after Apt plan was cancelled) and the real estate owner (an elderly woman) quoted an extremely high price for this rural area of upstate NY (about 16K per acre). I want to start an apple orchard and it would be nice to have it be across the street. I am afraid of offending this woman who seems to think all she has is extremely valuable (judging from listing prices of other things in town, her things never sell). She does not list through MLS. I think she owns what she lists. I have compared the lot to similar lots in this and neighboring towns, and I think a fair price would be closer to 5 or 6K per acre. Should I take a crap shoot and call her to ask about this land, and give her my "homework" on similar property without sounding too eager because this one is conveneint/close to me? What approach should I take? (Like, to convince her that it would be more profitable for her to sell it at a much lower price) More info: she has posted a large sign "Industrial Zoned" on it, and yet it is on a small rural road, and the closest "main" road has lots of vacant fields up for sale, why would anyone want commercial there when they can get more visibility? Plus i know the townspeople would fight a commercial or industrial application here. Should i just be honest and tell her I want a small farm? Should i tell her I am a local or would that make her think I was one of the "enemies" fighting the development a few years ago? (I signed a petition but did not fight at Town hall)

Land question in Mass? land contracts between neighbors? Land question in Mass? We live in Mass. Our lot is very odd shaped, we are discussing with our new neighbor (new land owner lot has not been built on yet) doing some type of land contract/ variance or legal agreement to adjust the lots so they are a little more functional. We both want the agreement to be included as a condition of sale, so that any future owner would have to uphold the land agreement, unless renegotiated by both parties. We are trying to avoid having to go through the town and actually having the lot lines officially re-drawn. Do to the rules/codes in our town we don't think they would agree to this not to mention the time and cost involved. We are under the impression that we could do this with out town approval as it is a contract between individual land owners. Has anyone seen this type of thing done before? Would you recommend having the areas of the lots that are being adjusted surveyed again? , in a Would a new survey hold up legally down the road? Would we need to survey a new survey for both lots? Or could it be done by just looking at the effected areas? If we go to the cost to do this we want to make sure that it is all legal and protected properly.

Do we own land that we have maintained for over 20 years? We bought our house 22 years ago, with came some land that was "joint owned" with 4 neighbours. When the land was bought the owner of our house was named as the owner with the 4 neighbours named as trustees. When we bought ownership was passed to us through consent with trustees. Twice trustee ship was passed on with with consent when other property was sold. This practice ceased when subsequent sales took place and now no original or consented trustees remain. Just the property occupied by the fence. National security can trump their claims. This issue is not London CT. where the City forced the sale to give land to a private entity. Real Estate Short Sale - should owner sign a Land Trust and Limited Power of Attorney? A friend and her ex-husband are on a mortgage together for home that that the husband is trying to do a short sale on to prevent foreclosure. My friend, the wife, was told that she had to go to a Realtor's office and sign some papers so a short sale package could be prepared (on a Saturday). At the Realtor's office she was told to sign a Florida Land Trust and a Limited Power of Attorney so the Realtor or whoever could have control of the property and wouldn't need to bother and call her and also called them Internal Documents and CYA. The office has a sign out front saying "Stop Foreclosure Now". I am concerned that this may be a foreclosure rescue scam. I told her to talk to an attorney before signing any documents, especially the Land Trust. I am afraid she will sign away the house and then still be held responsible for the mortgage. Ex-husband already signed the documents. Is the Land Trust and Limited Power of Attorney routine documents needed for a short sale package to be sent to the lender and/or routine "internal documents" to CYA the Realtor or whoever is really doing this deal? Why the "Limited Power of Attorney" when my friend and the ex-husband still lives in the same city where the house is located? Thank you for all your help!!!

If a home was purchased land contract, but the deed never registered thru purchaser, is purchaser legal owner? I have a judgment against purchaser of land contract sale of home. I was awarded a lien on propery. The seller is claiming that I can not have a lien because the deed was never registered. Even though he sold the home, he claims that he can prevent a lien on the home. His contract with the purchaser is that if there is a default he can then sell home and they must pay difference if selling price is less than owed. With that said, I have an order from the court to have the sheriff dept. sell the home and pay me first. He claims that since deed was not registered he is still the owner. Is a commercial business lease bw family members prior to a power of sale on the land still legal/binding? My uncle and aunt got hammered last year on their variety store/gas station business and fell behind on their payments on the property (which they also own). The mortgage company indicated they will do a power of sale on the land at the end of March if full payment is not made. last year i purchased a partial interest in 3 lots of land in the state of oregon from my brother in law and? who was co-owner with my husband. the paperwork i drew up to prove it was an "owner's sale and agreement and earnest money receipt", purchased at a local stationary store, where he acknowledged receipt of $5,000.00 paid by me, the balance of $30,000.00 due him upon the sale of the property. it is completed properly, however it was done in haste leaving no time to have it notarized. it is signed and dated by both of us outlining the details, and i gave him a cashier's check, drawn on a local bank. is this agreement legal and binding if should he decide to change his mind?
